Terms and Conditions for Working with MKA Law

1. Agreement to Terms

By engaging with MKA Law, you (the “Client”) agree to the following terms and conditions. These terms govern your relationship with MKA Law, its attorneys, and its staff for legal services rendered. Please read them carefully before proceeding.

2. Legal Services Provided

MKA Law offers professional legal services, including but not limited to:

  • Petroleum Licensing
  • Liquidations
  • Insolvencies
  • Contract Law
  • Divorce Law

These services will be provided based on the specific scope agreed upon in your individual retainer agreement. The scope of work will be outlined and agreed to in writing before services are initiated.

3. Fees and Payment

MKA Law is committed to providing transparent and fair pricing for legal services. The fee structure for services will be agreed upon before work begins and may be one of the following:

  • Hourly Rates: Based on the time spent on your matter.
  • Flat Fees: A fixed fee for specific services.
  • Contingency Fees: A percentage of any recovery obtained in certain cases, such as personal injury or debt recovery.

The Client will be notified of any changes to the fees and must approve any adjustments in advance. All invoices are due upon receipt unless otherwise agreed upon.

4. Billing and Payment Terms

Invoices for legal services are generally issued monthly or upon completion of significant milestones, as agreed. Payments are due within 30 days of the invoice date. Any overdue balances may accrue interest or additional fees.

Clients will be notified in advance of any costs or disbursements (such as court fees, travel costs, or third-party expenses) that are outside of the agreed fees.

5. Client Responsibilities

The Client agrees to provide complete and accurate information to MKA Law. The Client must also comply with any deadlines, requests for documents, or other necessary actions to support the legal process. Failure to do so may affect the firm’s ability to represent the Client effectively.

6. Confidentiality

All information shared between the Client and MKA Law will be treated as confidential. MKA Law will not disclose any confidential information without the Client’s consent, unless required by law or court order.

7. Conflict of Interest

Before taking on a new matter, MKA Law will conduct a conflict check to ensure that there is no conflict of interest in representing the Client. If a conflict is found, MKA Law will notify the Client and will either decline representation or resolve the conflict in an appropriate manner.

8. Termination of Services

Either party may terminate the legal services agreement at any time, with or without cause. If the Client decides to terminate, any outstanding fees for services rendered up to that point will be due immediately. If MKA Law terminates the agreement, the Client will be notified in writing and any unused retainer fees will be refunded.

9. Limitation of Liability

MKA Law will exercise reasonable care and skill in providing legal services. However, MKA Law cannot guarantee the outcome of any matter. The Client acknowledges that legal matters can be unpredictable, and MKA Law is not liable for any damages, losses, or consequences arising from the outcome of the legal services provided.

10. Dispute Resolution

In the event of a dispute between the Client and MKA Law, the parties agree to first attempt resolution through informal discussions. If resolution is not reached, the dispute may be submitted to mediation or arbitration before taking formal legal action. Jurisdiction for any disputes will be determined based on the location of the law firm.

11. Governing Law

This agreement will be governed by and construed in accordance with the laws of South Africa. Any legal proceedings related to these terms and conditions will be held in the courts of South Africa.

12. Amendments

MKA Law reserves the right to update and modify these terms and conditions at any time. Clients will be notified of any significant changes, and the latest version will be posted on the MKA Law website.
